Paxil lawsuits have been filed by people claiming to have suffered from debilitating side effects after using the drug Paxil. The drug was originally prescribed as an anti-anxiety medication for people suffering from obsessive compulsive disorder, depression, and post traumatic stress disorders.

The FDA received several reports of the effectiveness of Paxil in treating these problems but did not approve it for use until. It was then that a group of clinical trials were conducted and published in the Journal of the American Medical Association, which reported great success in treating patients with these problems. Since the FDA approved Paxil, many other antidepressant companies have tried to develop and produce drugs designed to do the same thing, but they have all failed.

Paxil Lawsuit

In one of the most publicized of the paxil lawsuit events, a jury found that the manufacturer GlaxoSmithKline was liable and should pay damages to a man who was born without a heart. The man, identified only as J.D., had taken the antidepressant Paxil for approximately two months without a doctor’s prescription. J.D. fell into a coma and later died, at the age of 29. The jury found that GlaxoSmithKline was responsible because the drug was found to have caused a variety of birth defects in J.D.

Another of the widely publicized Paxil lawsuit events involves a woman who was pregnant while taking the drug.

She claimed that she developed serious anxiety, depression, and mixed symptoms such as confusion, memory loss, and learning disabilities. Despite having a history of being pregnant with her first child, at the time of taking Paxil, she developed multiple sclerosis, a disease which causes inflammation of the brain and spinal cord. After developing this disability, the woman began receiving counseling to overcome her addiction to alcohol.

Shortly thereafter, however, she developed another addiction which involved taking the antidepressant Effexor. When asked if she would have done so if she had not been pregnant with her third child, the court found that the woman was indeed negligent for failing to obtain proper medical care and for failing to learn that depression, alcohol problems, and multiple sclerosis were associated with Paxil use.

One of the most high-profile Paxil lawsuit events involves a case which arose from a birth defect brought about by the drug.

The birth defect was caused when a pregnant woman became addicted to Paxil while taking the drug. The drug had not been approved for use by pregnant women before her miscarriage in 2021. Upon learning of the defect, the woman filed a lawsuit against GlaxoSmithKline, Inc.

The company settled the case, paying the woman a total amount of more than 390 million dollars. This amount of money is more than the settlement pays out because it also covers the costs associated with the woman’s treatment for hernia, nausea, and cerebral palsy.

While these are just two of the many Paxil lawsuit occurrences, they are among the most notable because they pertain to adolescents.

Although there is a vast majority of teenagers who suffer from depression, anxiety, and other mental health ailments, there are some who suffer from suicidal thoughts. Suicidal thoughts and attempts are an indication that a teenager has suffered chemical imbalances within his or her body.

In order to be able to win a paxil lawsuit, attorneys representing the plaintiff must prove that the defendant knew about the chemical imbalance in the patient and did nothing to correct the issue. Because of this requirement, many attorneys who file such lawsuits rarely receive any compensation from the defendant.

Other instances which frequently result in high settlements include mass tort suits.

Mass tort is when a person sues a company or person for an injury which resulted from the negligence of another party. Many companies choose to participate in mass tort whenever they are aware that their product has caused harm or death to a consumer. The company then uses the courts to force consumers to pay for their injuries and for the legal costs associated with the suit. As with paxil lawsuits, most people filing such cases never receive any compensation from the defendant.
